In Indiana, possession of less than three grams
of cocaine, methamphetamine, or narcotics is a
Class D felony. The charge is bumped up to a Class
C felony if the amount of the drug is three grams
or more or if the individual has a firearm on their
person. It becomes a Class B felony if it involves
a minor or takes place in any of the above mentioned
youth related places. The manufacture or dealing
of cocaine, methamphetamine, or narcotics is a
Class B felony. Again, the charged will be bumped
up to a Class A felony if it involves a minor or
takes place in any of the above mentioned youth
related places.
According to Indiana Code, fines and prison time for drug related felonies are:
- Class D Felony: up to three years in prison and a fine of up to $10,000.
- Class C Felony: up to eight years in prison and a fine of up to $10,000.
- Class B Felony: up to 20 years in prison and a fine of up to $10,000.
- Class A Felony: up to 50 years in prison and a fine of up to $10,000.
Possession of a controlled substance classified by the U.S. Drug Enforcement Administration (DEA) as a schedule I, II, III, or IV, is a Class D felony, except for marijuana or hashish. If the offense involves a minor or takes place in any of the above mentioned youth related places, the charge becomes a Class C felony. Possession of prescription drugs without a prescription is a Class C misdemeanor but becomes a Class A misdemeanor if the individual has a prior conviction for a similar offence. Possession of less than 30 grams of marijuana or less than two grams either hash oil, or hashish is a Class A misdemeanor. But, if it involves a minor or takes place in any of the above mentioned youth related places, the charge is then moved up to a Class D felony.
